There will be an appeal against any sentence if that comes out of Folkestone Magistrates Court in 1-2 weeks’ time or subsequently on 10 November 2023, 2 pm Trial Hearing which I will not attend (whichever way the authorities wish to proceed) as you have determined from your assessment of the legalities involved.


Further there will be counter prosecution against Kent Police and the Magistrates Court officials for criminal conspiracy against me on the grounds that at the initial stage of Pre-Trial Hearing, I was offered the opportunity to discuss the details of my plea with the North Kent Magistrates Court, as shown in the attached communication: Notice of New Date of Hearing NKMC.docx, and this was withdrawn, with a Magistrate deciding to send the matter to Trial instead.


So please standby for further instructions.

Your plea should have been guilty, you admit you are guilty of the offence. It is just the punishment that you disagree with.


The fact you were offered a speed awareness course, does not affect your guilt. This is an out of court disposal. If you could not make the date booked for whatever reason, Kent police do not have to offer an alternate date. The offer of the course is discretional. The course must be completed within a set period of time. It is possible that due to you cancelling the course, there was insufficient time for a further course to be offered.


It is for this reason a conditional offer of a fixed penalty was put to you. You can not simply offer to pay a fine and not have penalty points. The offer is of a fine and points. Again if you accept guilt you should have accepted the offer.


The fact the matter has now gone to trial for no “good reason” means you are liable for far more costs, and a fine dependant upon your income. This will be far in excess of the fixed penalty.


I would await the outcome of the hearing. You should be notified within 1-2 weeks. At that stage let me know and we can decide if it is worthwhile appealing the sentence, although that would be to the Crown Court and is likely to be prohibitively expensive.


It is a shame you did not obtain legal advice far earlier in this matter.

Your plea Not guilty Not guilty because I was told by Lucy at Kent Police that I am entitled to a Speed Awareness Course as I had never been offered one. So I booked a Speed Awareness Course paying £92 to Kent County Council and having a date of 11 January 2023 to complete this task. Due to mitigating circumstances in that I was embroiled in legal matters relating to Claim E35YM660 of the Central London County Court as Claimant and J00ME572 at Medway County Court that has now reached the Court of Appeal, I applied for a rescheduling of the Speed Awareness Course but well within the deadline for its completion. Kent Police for reasons of its own cancelled my Speed Awareness Course and sent me a Conditional Notice of Liability instead. I appealed against this but it did not respond. Then I said to the Police that I would pay the extra £8 without the Points on my Licence since it was Kent Police's fault that the Speed Awareness Course was cancelled unjustifiably in my assessment. When Kent Police did not reply to this submission, I offered to pay the £100 Fine and have the 3 Points on my Licence. Kent Police did not reply to this offer either. I have never challenged the possibility that I might have exceeded the 50 mph speed limit but am appealing to the Court that Kent Police has been unreasonable in not enabling me to discharge my liability that I always wanted to.

2. I then changed my plea from not guilty to guilty and the Hearing was shifted to Folkestone Magistrates Court as attached: FrSandraWhiteKentCPO(R v Dr Panigrahi 465J327153)9Oct2023.docx.


I was citing mitigating circumstances which I clarified in full over a few month period; and my inability to attend in person due to being a mental patient with paranoid schizophrenia who could not engage in meaningful conversations at a Hearing, was the reason it would appear that the Folkestone Magistrates Court and North Kent Magistrates Court have not been replying to my email communications: ToNorthKentMagCrtKingsBenchHighCrtKentPoliceOralesi(Gord&Thompson)HAS A DECISION BEEN MADE YET16Nov2023.docx.


So I have not a clue which Court is dealing with the Speeding matter and when it would be held. For this reason I need a new Criminal Defence Lawyer, the others I consulted found the complexity was beyond their expertise to handle

From what I can gather there was a trial listed today at 1400. This was to decide if you were speeding on the A229 on the 5th October 2022. I presume you previously entered a not guilty plea.


The hearing was listed for 10th November but was then brought forward to today.


If you wished to dispute the allegation and deny that you were speeding on the5th October 2022, you should have been in attendance to give your evidence. If you were not present, then the trail can proceed in your absence. This would have meant only the prosecution (police) evidence would have been before the court.


Were you aware of today’s hearing? If so when were you made aware of it?
