As I have indicated in the past the Notice of Issue was faulty (it had anomalies) so I do not accept it as a viable basis upon which to proceed with the matter in Court. The Court needs to reissue the Notice of Issue with the Fresh Particulars of Claim that you now have in your possession. In this regard I am awaiting the reports of the Solicitors Regulation Authority and the Legal Ombudsman as you should have been aware from our correspondence since you first sent me the Acknowledgment of Service. Your Application Notice is consequently premature if not null and void. I will contest any application for Costs to the Defendant of even a penny until Medway County Court rectify Notice of Issue.
