Dear Ms Scanlan


If that is your final decision on behalf of the Chief Constable of Kent Police, the Court should treat your email dated now as the Application Notice to strike out the Claim Form and the Injunction Application at a Hearing since you have acknowledged the UpToDate Claim Form and the particulars of Claim contained in my correspondence with the Supreme Court of the United Kingdom. As such your application will be treated as the Defence of the Chief Constable of Kent Police in order to bring this matter to a closure as soon as Medway County Court announces a decision on whether there is to be a Hearing or if the District Judge enters summary judgment in favour of the Claimant or the Defendant without a Hearing.


Please let me know immediately if you consent to this proposal.

For the avoidance of doubt, the court is advised that the defendant has filed and served an application to strike out and/or for summary judgment on 27 May 2022.


As advised in the covering letter to both the claimant and the court, the claimant has been put on notice that the defendant’s application notice relieves the defendant of the burden of filing a defence pursuant to CPR 12.3(3) until the hearing of the defendant’s application.
